In the name of God Amen The twenty sixth day of November AD 1791 - I Daniel Kennedy of Voluntown in the County of Windham & State of Connecticut, being weak of body but of a sound and disposing mind and memory; do make this my last will & testament, first and before all I reccommend my soul into the hands of God who gave it & my body to the earth to be buried in a decent mannar at the discretion of my Executors hereafter named; my worldy substance I give & bequeath in the following manner viz
Imprimus I give and bequeath unto my well beloved wife Lucretia the use & improvement of the whole of my real & personal estate untill my son John arrives at the age of twenty one years; and after he the sd John arrives at that age she is to have the use & improvement of the one third part of all my real & personal estate during her natural life; and also a debt of five pounds against Esqr Brewster
Item. I give unto my only son, John Kennedy all my real estate that I am possessed of in Voluntown together with the dwelling house the fulling (note: fulling is: The process of cleansing, shrinking, and thickening cloth by moisture, heat, and pressure.) mill & all tools & utensils thereunto belonging also the pot ash & kettles and all tools thereto belong with all my farming tools to him his heirs and assigns forever
Item. I give unto my eldest daughter Mary Partelo five pounds lwf to be paid her by my son John Kennedy in one year after he shall arrive to the age of twenty one years which with what she hath already had is the whole of her portion that I allow her out of my estate
Item. I give unto my second daughter Eunice Kegwin five pounds lawful money to be paid her by my son John in one year after he arrives at the age of twenty one years, which with what she hath already had is the whole of her portion that I allow her out of my estate.
Item. I give unto my third daughter Anna Kennedy one bed & furniture, and one cow with as much household furniture as will be equal to what one of her married sisters had formerly given them & her mother to be the person that shall judge of the quantity; and I also give her my newest desk which stands in the east room to be paid and delivered her out of my moveable estate in one year after my decease by my Executors hereafter named; and also five pounds lawfull money and half a score of sheep to be paid her by my son John when he arrives at the age of twenty four years.
Item. I give unto my fourth daughter Lucretia Harris five pounds to be paid her by my son John in two years after he arrives at the age of twenty on years which with what she hath already had is the whole of the portion I allow her out of my estate
Item. I give unto my fifth daughter Alice Kennedy one bed & furniture and one cow with as much household furniture as will be equal to what one of her married sisters had heretofore given them; her mother to be the person that shall judge of the quantity, to be paid and delivered her out of my moveable estate by my Executors hereafter named when she arrives at the age of twenty one years or on the day of her marrige if she is married before that time; and also the sum of five pounds lawfull mony & half a score of sheep to be paid her by my son John when he shall arrive to the age of twenty six years.
Item. I give unto my sixth & youngest daughter Elisabeth one bed & furniture & one cow with as much household furniture as one of her married sisters had heretofore given them, her mother to be the person that shall judge of the quantity to be paid and delivered her out of my moveable estate by my Executors hereafter named when she shall arrive at the age of twenty one years or if married before that time then to be paid on the day of her marriage; and also the sum of five pounds lawfl and a half a score of sheep to be paid her by my son John when he shall arrive at the age of thirty years
I also allow my three daughters Anna Alice & Elisabeth a right & priviledge to cut fire wood on the farm sufficient for them untill they shall marry or if they never marry then their priviledge to continue during their natural lives. Furthermore I give unto my son John Kennedy his heirs and assigns a small lot of land lying in Poquitanuck to enable him to pay legacies
And after my just debts & funeral charges are all paid which are to be paid out of my moveable estate my Executors hereafter named what of my estate remains undisposed of I give unto my son John Kennedy
And I do hereby nominate and appoint Asahel Partelo of Plainfield in sd County with my wife Lucretia and my son John Kennedy Executors to this my last will & testament hereby revoking & renouncing every other will or wills by me heretofore made, ratifying & confirming this to be my last Will & Testament In witness whereof I have hereunto set my hand and seal the day & year above written. In Voluntown on the 6th day of February AD 1792 personally appeared Allen Campbell John Campbell Junr & Joseph Kennedy & make solimn oath that they saw the within named Daniel Kennedy sign seal publish declare and deliver this his last Will & Testament on the day & year when dated & that he was of a sound and disposing mind & memory & that they signed as witnesses in presences of each other.
